I'm writing a book and need to know if I can use song or band names, lyrics or book titles which are probably copyrighted.
I'd like to use them in a context such as: 'She was listening to *Name of song*' or 'He was blasting *Name of song*' Or 'They were reading *name of book*'.
Anyone with any information about this will be a great help, thanks =]
It's perfectly legal, though you may want to consider how specific they are. If they're not relatively well-known cultural icons, you're going to alienate a lot of readers, or at least go over their heads with the references to things they don't understand. Try to keep it to things that are pretty universally known; bands and musicians like Bob Dylan, Nirvana, Led Zeppelin; books like War and Peace, Great Expectations, Harry Potter, Lord of the Rings; movies like Fight Club, Gone With the Wind; TV shows like Star Trek, Buffy the Vampire Slayer, Seinfeld; the list could go on and on, but the point is, make sure that the majority of your audience will be familiar with the referennames lyricsce.
A note: lyrics may be a little more on the questionable side, though I believe they fall under the umbrella of "Fair Use".
I prefer no mention, as a reader, it just throws me out of the fantasy of the story.
Legality- your publisher will probably get permission and if it is refused, you have to change it. I would avoid making them too important. After all, it's creative work, you can think of something that alludes to the book/song/band without actually naming it.
Many times in books i've read, the author gives reference to the song and artist, along with the year the song was made, on the copyright page. I do think that you need to ask for permission most times, ESPECIALLY if you plan on publishing the book
You should use an in-text citation in parentheses after the song name or a footnote. Then, write a reference in a bib or reference page at the end of the book describing things like who wrote the song, in what year , etc...
you can use it as long as you don't claim it as yours
just say the name of the names lyricssong but also write the band or artist's name so they don't think that you took it from them without giving credit
Yes, you can, but you can't plagiarize from them. So you can say they were reading it, but you can't just take a paragraph from it and claim it as your own.
lyric perhaps. but you can't copyright a name or a title.
there's nothing to stop you refering to specic songs etc, that happens all the time. so long as you don't quote them you should be fine
Yes. Any name that has been trademarked is illegal in whatever form you choose. Think of original names. There are places to know whether the names are still up for grabs like www.marcaria.com. Check those out first.
If its a short quote or referring back to a small part. Most cases you have to get in touch with the writer and get permission to use anymore.
No, but it would probably be best to call them if you ever plan on publishing the book.
